the facts and circumstances ofthe case.",

Iosertion of new section 30A, Act XL of 2016.-ln Act XL of
2016, after section 30, the following new sections shall be inserted, namelyr
"30A. Rem.rd.-{l) where a person is det ined for investigation, the
investigating officer, within twe[ty-four hours of the arlen, excluding the time
necessary for the joumey from the place of arr€st to the Court, shall produce the
accused b€fore lhe CouG and may apply for remafld of lhe accused to police
cusrdy, or custody of any other invesrgating agency joined in the inv€stigation
for which the msximum period allowed must not be more than fourteen days at
one time:
Provided that, where an accused ca.llnot within twentyfour hours be
produced before the CouG a temporary order for polic€ custody or custody of
any other investigating agency joined in the investigation not exc€eding twentyfour hours may be obtained fiom the nearest Magistmte for tie purpose of
producing the accused bcfore the Court within that p€riod.
(2) No exlension in time ofthe remand ofthe ac.used in police custody
or custody ofany other investigating agency joined in tie investigation shall b€
allowed, unless it can b€ shown by the investigating ofticer, to the satisfaction of
the Court that funier evidence may b€ available and the Coun is satisfied that no
bodily harm has been or will be causcd to the accused:
Provided that the total period
of such remand shall not in any
