Annex to the National Police Agency and the Communications Regulatory Commission's
Joint Orders A/200 and A/169, Issued August 27, 2020
REGULATIONS TO MITIGATE THE DISSEMINATION OF MISLEADING AND DEMONSTRABLY FALSE
INFORMATION REGARDING THE PANDEMIC IN CYBERSPACE
One. General grounds
1.1. This regulation prohibits misleading the public and the spread of blatantly false information about the Pandemic. This aligns
with Section 9.13 of the Law on Preventing and Combating the Pandemic of the Corona Virus /COVID-19/, and Reducing the
Negative Impact on Society and Economy. The aim is to coordinate regulations in the cyberspace to prevent the spread of such
misinformation.
1.2. The Communications Regulatory Commission shall comply with laws and regulations in the cyberspace in order to prevent the
public from misleading the public and the spread of blatantly false information in the cyberspace.
1.3. When mobile communication service providers, internet service providers, and online service providers (websites, social media
platforms, applications, etc.) take actions to regulate the cyberspace and prevent the spread of false information during a pandemic,
they must comply with the laws and regulations outlined in Section 1.2 of this regulation.
Two. Controlling the spread of false information in the cyberspace during the pandemic
2.1. The distribution of false information in the cyberspace during a pandemic will be monitored by the police, the state
administrative body in charge of professional supervision, and the Communications Regulatory Commission.
2.2. The reviewing bodies specified in Clause 2.1 of this regulation shall review the issues related to the spread of false information
during a pandemic in the cyberspace in accordance with relevant laws and regulations, and submit proposals and conclusions for
regulation to the Communications Regulatory Commission.
2.3. The opinions and conclusions specified in Clause 2.2 of this regulation shall be accompanied by the necessary documents such
as misleading public information, clearly false news, web addresses, e-links, and printed documents.
2.4. According to the opinions and conclusions specified in Section 2.2 of this regulation, the Communications Regulatory
Commission will take the following measures to limit the cyberspace that is misleading the public and spreading blatantly false news
and information.
2.4.1. to mislead the public, delete obviously false news and information or restrict access;
2.4.2. restricting access to web addresses and websites that mislead the public and distribute obviously false news and information.
2.5. The Communications Regulatory Commission will issue a notice to the Online Service Providers to limit the spread of
misleading, blatantly false news and information about the pandemic, and the aforementioned measures will be implemented
immediately within the specified period, and information about the implementation will be notified by e-mail, telephone, and sent in
an official letter.
2.6. If it is not possible to identify the online service provider, or if the measures specified in Section 2.5 of this regulation are not
implemented, the Communications Regulatory Commission shall deliver the following notification to the mobile communication
service provider and Internet service provider:
2.6.1. to limit the access of the relevant online service provider from Mongolia for a period of time until the pandemic subsides;
2.6.2. take technological measures prescribed by law.
2.7. The mobile communication service provider and the internet service provider shall undertake the obligation to immediately
implement the measures mentioned in the notice specified in 2.6 of this regulation, and shall notify the Communication Regulatory
Commission by e-mail, telephone, and send the information about the implementation in a formal letter.
2.8. The Communications Regulatory Commission shall consider the notice specified in Clause 2.5 of this regulation to have been
notified by sending it to the e-mail address of the online service provider or by e-mail registered to the Communications Regulatory
Commission.
Three. Cooperation of competent authorities
3.1. During an pandemic, the relevant authorities shall cooperate within the scope of restricting the spread of false news and
information in the cyberspace.
3.2. The authorized organizations specified in 3.1 of this regulation include intelligence organization, police organizations, state
administrative organization in charge of professional supervision, and the Communications Regulatory Commission.
3.3. Authorized organizations have issued a list of surnames, first names, positions, mobile and landline phone numbers, fax
numbers, and e-mail addresses of cooperating officials.
Four. Powers and duties of other related organizations
4.1. The mobile communication service provider and the internet service provider have the following responsibilities:
