административните нарушения и наказания. Допълнителни разпоредби Additional provisions § 1. По смисъла на този закон: 1. "Задължителни екземпляри" са екземпляри, подлежащи на депозиране по този закон. 2. "Произведения" са обекти по смисъла на чл. 3 от Закона за авторското право и сродните му права. 3. "Печатни произведения" са произведения, отпечатани върху хартия или друг носител по печатарски или подобен на него способ, включително и с брайлов шрифт за слепи. 4. "Звукозапис" е резултатът от фиксирането върху траен материален носител на изпълнение на произведение или друга поредица от звуци по начин, позволяващ тяхното възприемане и възпроизвеждане. 5. "Филм" е аудио-визуално произведение, предназначено за показване в киносалони или видеопоказ. Филмът може да бъде игрален, документален, научнопопулярен, анимационен или учебен. 6. "Издател" е физическото или юридическото лице, което организира възпроизвеждането на произведение и осигурява финансирането му. 7. (нова - ДВ, бр. 42 от 2009 г., в сила от 06.07.2009 г.) "Производител" е физическото или юридическото лице, което прозвежда тиражирани произведения за издател. 8. (предишна т. 7 - ДВ, бр. 42 от 2009 г., в сила от 06.07.2009 г.) "Продуцент" е физическото или юридическото лице, което организира осъществяването на звукозаписа или създаването на филма и осигурява финансирането им. 9. (предишна т. 8 - ДВ, бр. 42 от 2009 г., в сила от 06.07.2009 г.) "Повторно нарушение" е нарушението, извършено в едногодишен срок от влизането в сила на наказателното постановление, с което нарушителят е наказан за нарушение от същия вид. 10. (нова - ДВ, бр. 87 от 2010 г., изм. - ДВ, бр. 94 от 2018 г.) "Действителен собственик" е понятие по смисъла на § 2 от допълнителните разпоредби на Закона за мерките срещу изпирането на пари. 11. (нова - ДВ, бр. 87 от 2010 г.) " § 1. In the context of this Act: 1. "Required copies" are copies subject to deposition according to this Act. 2. "Works" are objects in the context of art. 3 of the Copyright and Related Rights Act. 3. "Printed matters" are works printed on paper or other carrier by printing or similar means, including by Braille script for the blind. 4. "Sound recording" is the result from the fixing on a durable material carrier of a performance of a work or other sequence of sounds in a way allowing their reception and reproduction. 5. "Film" is an audio-visual work designed for showing in cinemas or video show. The film can be feature film, documentary film, scientific film, animation or educational film. 6. "Publisher" is the individual or corporate body who organises the reproduction of a work and provides for its financing. 7. (new – SG 42/09, in force from 06.07.2009) “Manufacturer” shall be the natural person of the legal entity producing matters subject to circulation for a publisher. 8. (prev. item 7 – SG 42/09, in force from 06.07.2009) "Producer" is the individual or corporate body who organises the sound recording or the creation of the film and provides for their financing. 9. (prev. item 8 – SG 42/09, in force from 06.07.2009) "Repeated offence" is the offence committed within one year from the enactment of the penal provisions by which the offender has been punished for an offence of the same kind. 10. (new – SG 87/10, amend. – SG 94/18) “Actual owner” is a concept within the meaning of § 2 of the Additional Provisions of the Measures Against Money Laundering Act. 11. (new – SG 87/10) “Periodical printed matters” shall be matters – newspapers or magazines, which are issued in a sequential series within an period interval between the issues not longer than 6 months. 12. (new – SG 94/18) "Financing" shall mean any gratuitous receipt of cash or property and / or any other receipt of funds, irrespective of the legal form used, outside the revenues from the usual activity of the media services provider, as well as all borrowing and bank loans. 13. (new – SG 94/18) "Media service" is a concept within the meaning of § 1, item 15 of the Additional Provisions of the Election Code. 14. (new – SG 94/18) "Media service provider" shall be the provider within the meaning of § 1, item 16 of the Additional Provisions of the Election Code, including the publisher of periodical printed matter. 15.
