Article 22 Providers of deep synthesis services and providers of technical support for deep synthesis services who have violated the Provisions shall be subject to penalties in accordance with relevant laws and administrative regulations; if serious consequences have been caused, heavier penalties shall be imposed in accordance with the law. If a violation constitutes an act against public security administration, public security authorities shall impose penalties for violation of public security administration in accordance with the law; if a violation constitutes a criminal offense, criminal liability shall be pursued in accordance with the law. Chapter V Supplementary Provisions Article 23 For the purposes of the Provisions, the following terms shall have the following meanings: Deep synthesis technology refers to any technology that employs deep learning, virtual reality or any other generative or synthetic algorithm to produce text, images, audio, video, virtual scenes or other network information, including but not limited to: (1) technologies for generating or editing text content such as text generation, text style conversion, and Q&A generation; (2) technologies for generating or editing speech content such as text-to-speech conversion, voice conversion, and voice attribute editing; (3) technologies for generating or editing non-speech content such as music generation and background sound editing; (4) technologies for generating or editing biometric features in images or video content such as face generation, face swapping, personal attribute editing, face manipulation, and gesture manipulation (5) technologies for generating or editing non-biometric features in images or video content such as image generation, image enhancement, and image restoration; and (6) technologies for generating or editing digital characters or virtual scenes such as 3D reconstruction and digital simulation. Provider of deep synthesis services refers to any organization or individual who provides deep synthesis services. Providers of technical support for deep synthesis services refers to any organization or individual who provides technical support for deep synthesis services. User of deep synthesis services refers to any organization or individual who uses deep synthesis services to produce, reproduce, release or distribute information. Training data refers to annotated or baseline data sets that are used to train machine learning models. Immersive simulated scene refers to a virtual scene generated or edited using deep synthesis technology for participants to experience or interact with which conveys a strong sense of reality. Article 24 Provider of deep synthesis services and providers of technical support for deep synthesis services who are engaged in online publishing services, online cultural activities or online audio-visual program services shall also comply with the regulations of the corresponding press and publication, culture, tourism, or radio and television authorities. Article 25 The Provisions shall come into force on January 10, 2023. 5
