Section I "a". Crimes against creditors (New - SG 107/96) Чл. 227б. (Нов - ДВ, бр. 107 от 1996 г.) (1) (Изм. - ДВ, бр. 85 от 1998 г., изм. - ДВ, бр. 75 от 2006 г., в сила от 13.10.2006 г.) Търговец, който изпадне в неплатежоспособност и в 30-дневен срок от спиране на плащанията не заяви това пред съда, се наказва с лишаване от свобода до три години или с глоба до пет хиляди лева. (2) (Изм. - ДВ, бр. 26 от 2010 г.) С наказанието по ал. 1 се наказват и лицата, които управляват и представляват търговското дружество или кооперация, ако в 30-дневен срок от спиране на плащанията не са поискали от съда да открие производство по несъстоятелност. (3) С наказанието по ал. 1 се наказва и прокуристът, който не е изпълнил задължението си по чл. 626, ал. 3 от Търговския закон. (4) (Нова - ДВ, бр. 62 от 1997 г., изм. - ДВ, бр. 59 от 2006 г., в сила от 01.01.2007 г., доп. - ДВ, бр. 102 от 2015 г., в сила от 01.01.2016 г.) С наказанието по ал. 1 се наказват и лицата, които, като са били длъжни да уведомят Българската народна банка за изпадане на банка в неплатежоспособност, съгласно Закона за кредитните институции, както и лицата, които, като са били длъжни да уведомят Комисията за финансов надзор за изпадане на застраховател или презастраховател в неплатежоспособност, съгласно Кодекса за застраховането, не са извършили това. Art. 227b. (New - SG 107/96) (1) (Amend. - SG 85/98; amend. – SG 75/06, in force from 13.10.2006) An entrepreneur who becomes insolvent and, within 30-days from suspending the payments, does not declare it in court, shall be punished by imprisonment of up to three years or by a fine of up to five thousand levs. (2) (Amend. – SG 26/10) The penalty under para 1 shall also be imposed on the persons who manage and represent the trade company or cooperation if, within 30 days from suspending the payments, they have not requested the court to institute bankruptcy proceedings. (3) The penalty under para 1 shall also be awarded to the procurator who has not fulfilled his obligation under art. 626, para 3 of the Commerce Act. (4) (New - SG 62/97; amend – SG 59/06, in force from 01.01.2007; suppl. - SG 102/15, in force from 01.01.2016) The penalty under para 1 shall also be imposed on the persons who, being obliged to inform the Bulgarian National Bank about the insolvency of a bank according to the Credit institutions Act, as well as the persons, who were obliged to notify the Commission of Financial Supervision of the insolvency of an insurer or a reinsurer according to the Insurance Code, have not done it. (1) Търговец, който след откриване на производство по несъстоятелност: 1. скрие, унищожи, повреди или отчужди безвъзмездно пари, вещи, ценни книжа или други ценности, които могат да послужат за удовлетворяване на неговите кредитори; 2. отчужди пари, вещи, ценни книжа или други ценности, които могат да послужат за удовлетворяване на неговите кредитори, когато даденото значително надхвърля полученото и е извършено в противоречие с нормалното водене на стопанската дейност; 3. опрости или скрие свое вземане; Art. 227c.
