Article (10)
The data associated with the document or record for the purpose of facilitating
its sending or receiving should not necessarily fulfill the conditions set forth in
the preceding Article.
Any person may use the services of another person who obtains a license
in storing and retrieving documents and data if required by law to be saved
subject to the fulfillment of the conditions set forth in the preceding Article.
The provisions of the preceding Article shall not prejudice the provisions
or other laws or any specific procedures established by the government
concerning the storage of documents.
Article (11)
A. If the creator has himself issued the document or record.
B. If the addressee has used an election data processing system, which he
has already, agreed with the creator to be used for this purpose.
C. If the addressee has received the electronic document or record as a
result of procedures done by any person who belongs to the creator
or his representative who have access to the electronic means used by
either of them to identify the creator.
The electronic document or report may not be deemed an evidence against
the creator in the two following cases:
1. If a notice is served to the addressee informing him that the electronic
document or record is not issued by the creator. Therefore, the addressee
should act on the basis that the creator has not issued the document or
record. The creator shall hold the responsibility for any consequences
that occurred prior to the receipt of such notice unless proven that the
electronic document or record is not actually issued by the creator.
2. If the addressee becomes aware or was able to learn that the creator
did not issue the electronic document or record.
3. The addressee shall have the right to consider each electronic message
received as an independent correspondence. He shall act accordingly
unless he learnt or was able to learn, if he exercised the due diligence
of the natural person or used any agreed procedure, that the electronic
message was a duplicate.
